The Supreme Court on Wednesday heard a petition seeking a stay on the FIR against the makers and actors of the web series Thandava. After lengthy discussion and vigorous argument, the bench issued notices on appeals to transfer and club FIRs in 6 different states of the country. Rejecting the appeal to grant interim protection from arrest to the accused makers, actors and producers, he said the facility provided that the petitioner is free to appeal for bail in the concerned court.

The case was handed over
Complaints have been lodged in 6 states against all the accused in the Tandav controversy. Therefore, the defense counsel referred the case of Arnab Goswami and Amish Devgan and sought protection. A division bench of the court granted protection to Arnab during the hearing while Amish was protected from arrest. At the same time, orders were issued to club the complaint against Amish and transfer him to Ajmer.

Nariman: The scenes in the series that were objected to have been removed. We have also apologized.
Justice Bhushan: You want us to dismiss all the cases. Go to the High Court for that.
Nariman: Article 19A is in this country and my right under it should not be affected.
Justice Bhushan: There is also Article 31 of the Constitution. You go to the High Court.
Rohatgi: Section 19A can be approached directly to the Supreme Court.
Luthra: A case has been registered against my client. Arrests can occur. Stay on it.
Rohatgi: This is a political satire. If people start getting upset over small things then gradually art, cinema and TV will all come to an end in the country.
Agarwal: An actor cannot be held responsible for a character’s dialogue.
Justice Shah: You must have signed the contract only after reading the script of the web series. How can you say that is not your responsibility. You can’t hurt people’s religious feelings.
Justice Bhushan: We are not hearing on interim bail.
Agarwal: The scenes of the character are not shown to the actor.
Rohatgi: Transfer all the cases to one place.
Justice Shah: We issue notice in this matter
